The federal Personal Responsibility and Work Opportunity Reconciliation Act (PRWORA) established a lifetime ban on individual convicted of drug felony offenses receiving TANF or food stamps but allows states to “opt out” of or modify that ban.  Many states have done so, often in order to ensure that these benefits will be available to residential treatment programs so they can serve addicted individuals in the criminal justice system.  For a complete description of each state’s laws on this issue, see the Legal Action Center’s report, After Prison: Roadblocks to Reentry, at www.lac.org/roadblocks.html
