SAMHSA Releases Proposed Changes to 42 CFR Part 2 (Alcohol/Drug Confidentiality Rules)

February 5, 2016 – The U.S. Substance Abuse and Mental Health Services Administration (SAMHSA) today released a Proposed Rule proposing changes to the federal alcohol and drug confidentiality regulations found at 42 CFR Part 2. According to SAMHSA, the goal of the proposed changes “is to facilitate information exchange within new health care models while addressing the legitimate privacy concerns of patients seeking treatment for a substance use disorder.”

Prior to releasing the Proposed Rule, SAMHSA held a Listening Session in 2014 to solicit input on possible changes to the federal regulations. The Legal Action Center is looking forward to studying today’s Proposed Rule and offering our comments in the near future.
