The Legal Action Center will be issuing a revised edition of our acclaimed publication, Confidentiality & Communication: A Guide to the Federal Alcohol and Drug Confidentiality Law and HIPAA (2012). The new edition will reflect the 2017 and 2018 amendments to the federal confidentiality law for substance use disorder patient records, 42 CFR Part 2. For more information about the 2017 and 2018 amendments to 42 CFR Part 2, please visit LAC’s confidentiality resources.

The newest edition will also incorporate the information in the 2014 insert to Confidentiality & Communication, which covered the HITECH Act’s amendments to the Health Insurance Portability and Accountability Act (HIPAA).

Confidentiality & Communication can help your agency understand and apply the confidentiality law, as well as assist your agency in updating policies, procedures, and training protocols following the 2017 and 2018 amendments to 42 CFR Part 2.

The next edition of LAC’s book, Confidentiality & Communication, is currently expected to be released in 2019.

In the meantime, LAC attorneys are offering a two-part, introductory overview to HIPAA and 42 CFR Part 2, the two federal laws that protect the privacy of patient records at substance use disorder treatment programs. For more information about upcoming webinars, please visit LAC’s events.
